Sales basis against tips basis
A tip-out calculated as a percentage of sales is owed regardless of what was actually tipped. On a section that tipped poorly, the obligation can approach or exceed what was collected, and the server absorbs the difference personally.
A tip-out calculated as a percentage of tips moves with the night. A quiet or badly tipping shift costs proportionally less, and the risk of a bad section is shared across everyone in the pool rather than landing on one person.
Which basis a house uses is therefore not a technicality. It determines who bears the risk of a bad night, and it is the single most consequential detail in a tip-out policy — which is why it should be in writing and why an unwritten tip-out is such a reliable source of dispute.
Who can lawfully share
Rules on tip pooling vary considerably and are among the more actively enforced parts of wage law. A common structure permits sharing among staff who customarily receive tips and excludes managers, supervisors and owners entirely, on the basis that a tip is intended for the service staff.
Whether back-of-house staff can share is a separate question with different answers in different places, and in some systems it turns on whether the employer takes a tip credit against the minimum wage. Where a credit is taken, the permitted pool is usually narrower.
Minimum wage interacts with all of this. In several jurisdictions a tip-out cannot lawfully take a worker below the applicable minimum for the hours worked, which puts a floor under exactly the bad-night scenario a sales-based tip-out creates.
Service charges, card tips and tax
A mandatory service charge is legally distinct from a discretionary tip in most systems. The charge is typically the employer's revenue, which they may choose to distribute; the tip generally belongs to staff. The distinction determines both who has a claim on it and how it is taxed.
Card tips are usually distributed through payroll with tax withheld, and whether card processing fees can be deducted from them varies — some jurisdictions prohibit it outright. Cash tips remain the individual's obligation to declare, and they are taxable everywhere.
Some countries use an independently controlled arrangement for pooling and distributing tips, which can change the social contribution treatment of the payments. It only works if the arrangement is genuinely independent of the employer, and the independence requirement is the part most often got wrong.
